Terms of Use

Preface

Oh My Glasses Inc. (hereinafter referred to as “Oh My Glasses”) provides services to users who browse this website or make purchases (hereinafter referred to as “Users”) in accordance with these Terms of Use.

By using Oh My Glasses (hereinafter referred to as “the Website”; including any future website if the name, domain, or content is changed), or by purchasing products or services through the Website, Users are deemed to have agreed to these Terms of Use, the Privacy Policy, and other related regulations. Please read these carefully.

Article 1: Scope and Amendments

  1. These Terms apply to the provision and use of the Website between Oh My Glasses and Users.

  2. Oh My Glasses may amend these Terms without prior consent from Users. Users will be notified of any changes. If a User continues to use the Website or does not withdraw within a specified period after notification, they are deemed to have accepted the revised Terms.

Article 2: Definition of Users

Users refer to individuals who browse the Website, make purchases, or otherwise use the Website. Use of the Website constitutes acceptance of these Terms.

Article 3: User Registration

Registration

Users must register when making their first purchase on the Website. Registration must be completed in accordance with procedures specified by Oh My Glasses.

Users under 20 years of age (legal age in Japan) must obtain parental consent, and registration and orders must be completed by a parent or guardian.

Registration is completed upon approval notification from Oh My Glasses.

Registration is limited to residents in Japan.

Email addresses and passwords are for personal use only and may not be transferred or shared. All actions performed using these credentials are deemed actions of the registered user, and the user bears full responsibility.

Oh My Glasses may refuse registration if the applicant has previously violated these Terms or if there are concerns about false or inappropriate information.

Account and Password Management

Users are responsible for managing their email address and password.

Users must not transfer, lend, or disclose their credentials to third parties.

Oh My Glasses shall not be liable for any damages arising from improper management or unauthorized use of accounts.

If unauthorized use is discovered, Users must immediately contact Oh My Glasses.

Users are responsible for assessing risks when transmitting credit card or other payment information.

Suspension or Cancellation of Accounts

Oh My Glasses may suspend services or cancel accounts without prior notice if a User:

  • Previously had registration revoked

  • Violates payment obligations

  • Violates Article 3 or prohibited matters

  • Is affiliated with antisocial forces

  • Otherwise violates these Terms

Termination of the Website

Oh My Glasses may terminate the Website due to operational reasons with notice to Users, but shall not be liable for any damages resulting therefrom.

Withdrawal

Users wishing to withdraw must follow the procedure on the withdrawal page.

After withdrawal, personal data usage will cease and newsletters will stop. Oh My Glasses may retain certain data.

Outstanding orders will still be processed and delivered.

Users will no longer be able to view order history after withdrawal.

Transfer of Rights and Obligations

Users may not transfer or assign rights or obligations under these Terms without prior written consent from Oh My Glasses.

Prohibited Actions and Liability

Users must not engage in the following:

  • Providing false information

  • Disrupting operations

  • Unauthorized credit card use

  • Unauthorized use of accounts

  • Causing harm or disadvantage to others or the company

  • Infringing intellectual property or privacy rights

  • Violating laws or public order

  • Placing orders without intent to purchase

  • Impersonation

  • Sending harmful programs

  • Altering website information

  • Other inappropriate conduct

Violations may result in civil and criminal liability.

Personal Information Handling

Personal data will be used only within the scope defined in these Terms and the Privacy Policy.

Users may opt out of email communications.

Data will not be shared with third parties except with consent or legal obligation.

Third-party contractors may process data under supervision.

Users may request access, correction, deletion, or suspension of data use.

Provision of data is voluntary, but may affect service usage.

Cookies and similar technologies are used for service improvement.

Article 4: Orders and Purchases

Orders are placed according to Website procedures.

Orders are considered valid when placed using registered credentials.

Oh My Glasses is not responsible for failed orders due to network issues outside its control.

Services are limited to Japan.

A contract is formed when an order confirmation email is sent.

Article 5: Pricing and Payment

All prices include tax.

If pricing errors occur:

  • If higher than MSRP, MSRP applies

  • If lower, Users will be notified before shipment

Payment must follow specified methods.

Late payments incur 14.6% annual interest.

Order limit: 300,000 JPY per order.

Article 6: Delivery

Delivery is limited to Japan.

Standard delivery: 2–7 days if in stock, excluding delays due to:

  • Absence of recipient

  • Holidays, disasters, or transport issues

  • High order volume

  • Remote areas

  • Special notes on product page

Ownership transfers upon delivery. Risk transfers according to carrier handling.

Article 7: Returns and Refunds

Returns are subject to the return policy. Generally accepted if:

  • Unused or only lightly tried indoors

  • Defective or incorrect items

  • Within return period

Refunds may take 20+ business days. Credit card refunds depend on issuing banks.

Article 8: Product Information

No guarantee is given regarding accuracy or completeness of product descriptions.

Article 9: Intellectual Property

All content is owned by Oh My Glasses or licensors and protected by law.

Trademarks such as “Oh My Glasses” and “Oh My Glasses TOKYO” are protected.

No rights are transferred to users under these Terms.

Article 10: Disclaimer

Use of the Website is at the User’s own risk. No warranties are provided.

Oh My Glasses is not liable for damages unless due to gross negligence.

Liability is limited to the purchase price (or 1,000 JPY if free).

Article 11: Transfer of Business

Oh My Glasses may transfer business operations, including these Terms and user data, with prior user consent deemed granted.

Article 12: Term

These Terms remain effective from registration until withdrawal.

Article 13: Surviving Clauses

Certain provisions remain valid after termination, including liability, data handling, and intellectual property clauses.

Article 14: Governing Law

Japanese law shall govern all disputes.

Article 15: Jurisdiction

Tokyo District Court or Tokyo Summary Court shall have exclusive jurisdiction.

Article 16: Supplementary Provisions

Oh My Glasses may modify or discontinue services. Continued use implies acceptance.
